AgrowSky Terms of Use

Version 1.0 · Effective September 25, 2026

These Terms of Use ("Terms") govern access to and use of the website, platform, applications and services offered under the AgrowSky brand (together, the "Platform"). The Platform is owned and operated by CASTTI TECNOLOGIA LTDA., a Brazilian limited liability company registered under CNPJ 27.240.877/0001-06, headquartered in São Paulo, SP, Brazil, [FULL HEADQUARTERS ADDRESS] ("Castti", "we", "us" or "AgrowSky").

By creating an account, starting a free trial, subscribing to a plan or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

1. Eligibility

1.1. You must be at least 18 years old and able to enter into a binding contract.

1.2. If you accept these Terms on behalf of a company, cooperative or other organization ("Customer"), you represent that you have authority to bind it. In that case, "you" means the Customer and the users it authorizes.

1.3. The Platform is intended for professional use by drone pilots and operators, spray service companies, growers, cooperatives, ag retailers and their staff.

2. Definitions

  • Account: the registration that grants access to the Platform.
  • Customer: the individual or entity that subscribes to a paid or free plan.
  • Authorized User: a pilot, operator, manager or staff member the Customer adds to its Account.
  • Customer Data: all information entered, uploaded or generated by the Customer and its Authorized Users, such as flight logs, telemetry, field boundaries, product labels, licenses, and data about pilots, growers and aircraft.
  • Records: application records, reports and other documents generated by the Platform from Customer Data.
  • Farmer Portal: the free area where growers receive and view Records shared by operators that use AgrowSky.
  • Allowance: the monthly treated area (acres or hectares) included in a plan.
  • Overage: treated area above the Allowance in the same billing cycle.

3. What the Platform does

3.1. AgrowSky organizes and automates documentation for agricultural drone spray operations. It turns flight logs and Customer-provided data into application records, operational reports, expiration alerts for licenses, registrations and maintenance, and audit trails.

3.2. The Platform is brand-agnostic and accepts logs from different drone manufacturers in the formats listed in our help documentation. Manufacturers may change formats without notice. We will use reasonable efforts to keep up, without guaranteeing a timeline.

3.3. Coverage varies by market and plan. In the United States, the Platform supports only the states expressly listed on the pricing page, currently Florida (FDACS) and Texas (TDA), plus federal records. We do not claim coverage of any state, rule or country not expressly listed.

3.4. Features labeled "coming soon", "roadmap" or similar are not part of your subscription until released.

4. No guarantee of regulatory compliance

4.1. AgrowSky is a documentation tool. It does not provide legal, agronomic or aviation advice and does not replace licensed applicators, certified pilots or the operator.

4.2. You remain solely responsible for the legality of your operations. This includes, among other obligations:

  • aircraft registration and pilot certification, such as under FAA Parts 107 and 137;
  • applicator licensing;
  • using registered products according to the label, as required by FIFRA and state law;
  • airspace and safety rules;
  • keeping and producing the records that regulators require.

4.3. Review every Record before issuing, signing or submitting it to any regulator, grower, certifier or buyer. Records reflect the data they are built from. Incomplete, incorrect or altered data produces incorrect Records.

4.4. We are not liable for fines, citations, stop-work orders, crop losses, drift, or damage to third parties or the environment arising from your operations, nor for decisions made based on Records.

5. Accounts

5.1. Keep your registration information accurate and up to date.

5.2. Credentials are personal. The Customer is responsible for all activity under its Account and for its Authorized Users, including the roles and permissions it assigns.

5.3. Notify us immediately of any suspected unauthorized access at hello@agrowsky.com.

5.4. We may refuse or close registrations that show signs of fraud, false information or violation of these Terms.

6. Plans, pricing and payment

6.1. Plans. Plans, prices, Allowances, user limits and features are those published on the pricing page at the time of purchase. For Enterprise plans, they are those in a signed order form. The Farmer Portal is free.

6.2. Auto-renewal. Paid plans are billed monthly or annually and renew automatically for the same period until you cancel. You authorize recurring charges to your payment method.

6.3. Payment processing. In the United States, payments are processed by PayPal, by card or PayPal balance. Card details are handled by PayPal and Castti does not store card numbers. Your use of PayPal is also subject to PayPal's terms.

6.4. Allowance and Overage. Unused Allowance does not roll over. We will notify you at 80% and 100% of your Allowance. Overage is billed in the next cycle at your plan's per-acre rate and never blocks your work.

6.5. Add-ons. Additional pilots or operators, additional states, seasonal pilots and other add-ons are billed at current rates.

6.6. Plan changes. Upgrades take effect immediately and are prorated. Downgrades take effect at the start of the next cycle.

6.7. Price changes. We will give at least 30 days' notice of price changes, effective from your next billing cycle. Annual plans keep their price until the end of the paid term.

6.8. Taxes. Prices exclude sales and use taxes unless stated otherwise. Applicable taxes may be added based on your billing address. You are responsible for any taxes other than taxes on our income.

6.9. Late payment. If a payment fails, we may retry the charge and, after 15 days and prior email notice, suspend access until payment is made. Customer Data is preserved and remains exportable during suspension.

7. Free trial

7.1. The free trial gives access to the Team plan for 14 days, with no credit card required and a limit of 1,200 acres of treated area.

7.2. You will not be charged automatically when the trial ends. To continue, subscribe to a plan. Trial data remains available for 30 days after the trial ends and may be deleted afterwards.

7.3. We offer one trial per Customer and may end trials that are abused.

8. Founders Program

8.1. The first 20 paying Customers who join the Founders Program receive 40% off the list price of their plan for as long as the subscription stays active without interruption.

8.2. In return, the Customer takes part in one monthly feedback call, up to 45 minutes, with the AgrowSky team.

8.3. The benefit is personal, non-transferable and cannot be combined with other offers. It ends upon cancellation, non-payment for more than 30 days, or repeated refusal to take part in feedback calls after notice. Spots are allocated in order of confirmed purchase.

9. Cancellation and refunds

9.1. You may cancel at any time in the Platform or by email. Cancellation stops future renewals, and access continues until the end of the paid period.

9.2. Except where required by applicable law, payments are non-refundable and we do not provide prorated refunds for partial periods.

9.3. Your data after termination. After cancellation or termination, Customer Data and Records remain available for export for 90 days. After that, they are deleted or anonymized, except as required by law. Regulatory record-keeping periods apply to you: you are responsible for exporting and keeping your Records.

10. Acceptable use

You must not:

  • enter false data, alter flight logs, or use the Platform to fabricate, conceal or "clean up" applications that did not happen as recorded;
  • use the Platform for unlawful purposes or to infringe the rights of others;
  • upload personal information about others without a lawful basis;
  • access accounts, areas or data without authorization, probe for vulnerabilities without prior written permission, or circumvent technical or plan limits;
  • reverse engineer, decompile or copy the Platform, except as permitted by law;
  • scrape, overload or introduce malicious code into the Platform;
  • resell or provide the Platform to third parties without a specific agreement;
  • remove proprietary or identification notices from Records.

11. Customer Data

11.1. The Customer owns Customer Data. The Customer grants Castti a limited, non-exclusive license for the term of the subscription to host, process, reproduce and display Customer Data only as needed to provide and improve the service, support you and comply with law.

11.2. We may create and use aggregated, de-identified data that does not identify you, any individual or any property, for statistics, research and product improvement.

11.3. You are responsible for the accuracy and legality of Customer Data, including personal information of pilots, staff, growers and licensed professionals.

11.4. For personal information within Customer Data, the Customer is the controller (business) and Castti acts as processor (service provider), following the Customer's instructions, these Terms and our Privacy Policy. Enterprise Customers may sign a separate Data Processing Agreement.

12. Verifiable records

Records may include a SHA-256 hash and a verification QR code. These show that a Record has not been altered since it was issued. They do not certify that its content matches what happened in the field, which depends on the data you provide.

13. Farmer Portal

When you share Records with a grower through the Farmer Portal, you authorize the grower to view and download them, and you confirm you have the right to share them. Growers using the Farmer Portal are also bound by these Terms and may keep copies of Records they received.

14. Intellectual property

14.1. The Platform, its software, interfaces, trademarks (including "AgrowSky"), logos, templates and other content belong to Castti or its licensors.

14.2. During your subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform under your plan. No other rights are granted.

14.3. We may freely use any feedback or suggestions you provide, without obligation to you.

15. Availability and support

15.1. We aim to keep the Platform available around the clock, but we do not guarantee uninterrupted or error-free service. Service levels with credits apply only where set out in an Enterprise agreement.

15.2. We will try to announce scheduled maintenance in advance and perform it during low-usage periods.

15.3. Support is provided through the channels and hours listed for your plan.

15.4. We keep backups, but you should regularly export the Records you are legally required to keep.

16. Third-party services

The Platform relies on third parties such as cloud providers, PayPal, email services and drone manufacturers. We are not responsible for their failures or changes outside our reasonable control. Links to third-party sites are not endorsements.

17. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". CASTTI DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT USE OF THE PLATFORM WILL RESULT IN REGULATORY COMPLIANCE.

18. Limitation of liability

18.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTTI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, CROPS OR DATA, OR FOR FINES OR PENALTIES IMPOSED ON YOU.

18.2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTTI'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM WILL NOT EXCEED THE AMOUNTS YOU PAID IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

18.3. These limits do not apply to fraud, willful misconduct or where the law does not allow them.

19. Indemnification

You will defend and indemnify Castti against third-party or regulatory claims, and related reasonable costs including attorneys' fees, arising from your use of the Platform in breach of these Terms or the law, or from data you uploaded without a lawful basis.

20. Suspension and termination

We may suspend or terminate access, with notice where practicable, for:

  • breach of these Terms;
  • non-payment;
  • suspected fraud or security risk;
  • an order from a competent authority.

Provisions that by their nature should survive termination will survive, including those on intellectual property, disclaimers, limitation of liability, indemnification and governing law.

21. Changes to these Terms

We may update these Terms. We will give at least 30 days' notice of material changes by email or in the Platform. If you disagree, you may cancel before the changes take effect. Continued use after that date means you accept the updated Terms.

22. General

  • Assignment: we may assign these Terms in connection with a merger, acquisition, reorganization or transfer to an affiliate, including a U.S. entity created to serve U.S. customers, with notice to you.
  • No waiver: failing to enforce a right does not waive it.
  • Severability: if any provision is held invalid, the rest remains in effect.
  • Entire agreement: these Terms, the Privacy Policy and any Enterprise agreement are the entire agreement between the parties. An Enterprise agreement prevails in case of conflict.
  • Language: these Terms are available in English and Portuguese. In case of conflict, the Portuguese version prevails, except where local law requires otherwise.
  • Export and sanctions: you may not use the Platform in violation of U.S. or other applicable export control or sanctions laws.

23. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of São Paulo, SP, Brazil have jurisdiction. This does not affect any mandatory consumer protection rights you may have under the laws of your state of residence. Before starting any legal action, both parties will first try to resolve the matter in good faith by email.
